JUDGE BAYLSON CLARIFIES APPROPRIATE VEHICLES FOR SEEKING ATTORNEY’S FEES, PUNITIVE DAMAGES AND COMPENSATORY DAMAGES (Philadelphia Federal)


On this case, Philadelphia Federal Choose Baylson reiterates:

  1. Claims for breach of an insurance coverage contract don’t permit for restoration of lawyer’s charges; reasonably, lawyer’s charges on this context are solely permitted underneath the Dangerous Religion Statute.
  2. Widespread legislation breach of an insurance coverage contract claims don’t permit for punitive damages; reasonably, punitive damages on this context are solely permitted underneath the Dangerous Religion Statute.
  3. The Dangerous Religion Statute doesn’t present for restoration of compensatory damages.
